The other Green motion to dismiss

Here's a link to the other motion to dismiss in United States v. Green. Of course, the motion is technically wrong in saying that there is no mandatory minimum for premeditated murder and felony murder in the military justice system. See UMCJ art. 118, 10 U.S.C. § 918 (2000). What I suspect the motion meant to say is that the convening authority is not bound by the statutory mandatory minimums and may (and in the case of some of Green's alleged co-conspirators, did) approve a sentence less than the statutory mandatory minimum.
