New CAAF Decision: Not Toying Around
CAAF decided United States v. Toy, No. 07-0316/NA, __ M.J. __ (Jan. 17, 2008). CAAF held that MRE 317(a) does not incorporate state law regarding the intent level required to make non-consensual wiretapping illegal (under 18 U.S.C. § 2511(2)(d)) and excludable in a subsequent court-martial.
