In addition to a new decision, the C.A.A.F. website indicates that judges Stucky and Ryan were sworn in on December 20, 2006. Interestingly, neither judge participated in the Lee decision. Does this reflect a decision on the Court that the two new judges will not participate in the cases argued last fall?
