More on Green sentencing

Here's a link to today's NYT article on the former PFC Green's sentence. The Times reports that the jury deadlocked on sentence, resulting in life without eligibility for parole.

Given the tenor of comments about this case, I can't help but think, how could a judge deny a capital mitigation expert in a capital case? Unless this is the one capital case where counsel developed all their own mitigation evidence, this case is exactly why you hire a social worker-private detective, it just takes one juror that buys the mitigation arguments.
