Cert denied in Rose

The Supreme Court today denied cert in Rose v. United States, the cert petition seeking review of CAAF's decision upholding a conviction for refusing to submit to the anthrax vaccine.

The Court must not have gotten my memo on "The Golden CAAF."

Your memo was fine. The case was not. What the Court read was a dispute between a United States District Court and the C.A.A.F. and an interesting controversy that the FDA resolved with its second sham order in as many years. What is disturbing is the C.A.A.F.'s opinion, which is perhaps the finest display of judicial realism that the Court has ever handed down. I put as a close second the Article 134 jurisprudence dealing with child pornography.
