CAAF released its first opinion of the Term today, which is available here. United States v. Brown, __ M.J. ___, No. 07-0286/AR (C.A.A.F. Nov. 30, 2007). Judge Stucky for a unanimous court upholding an unpublished ACCA ruling for the government.

I am mildly surprised that CAAF granted on this case; it doesn't seem an especially close call, in light of Vidal and Hardy.
Wow our readership is getting a little demanding! If a reader has analysis before something is posted by CAAFlog (not just the man, but any contributor) please feel free to leave your thoughts. We will incorporate reader's comments, as we frequently do, in later posted analysis of the case.

With all respect to the dead, Guert, Schenectady is not upstate New York. As a born and bred Fultonian, I can say you must be appreicably north of Albany to be a true upstater.

I believe it is right next to Benedict Arnold's in the pauper's cemetery. Shouldn't be too hard to find.
